HJ late summer cap + eagle

Hello, I have come across this late HJ summer cap that has a metal eagle above the cloth diamond. Would this have been allowed under the regulations, and what was the significance of it ,higher rank perhaps? I have only seen cloth eagles on these hats, on the early version, so I am curious. There is some background on the summer cap and the eagle here:


With the above in mind, in that configuration the cap is against regulations. The standard HJ summer cap either had a cloth eagle and the HJ diamond or just the cloth diamond (personnel without any rank). This is shown in orders from 1936, 1937, 1938 and 1939. By 1942/3 orders show that nothing had changed other than the introduction of the cloth diamond in 1940.

Unless I'm mistaken the cap appears to have traces of where the cloth eagle was unpicked so either someone during the period incorrectly added a metal eagle because the cloth eagle was missing from his cap or someone added the metal eagle post-war.
 
I think this H.J. Sommer Mütze should be with me in a few days and then I can have a better look at the eagle and / or if a cloth eagle has been taken off. I do have the possibility to return it if it is wrong.

I do understand and I did try to cancel my order after I read your respond but it was to late. But I do have a 2 weeks return right and if it turns out you are right it will go straight back .
